Obsera.com Terms of Service

Introduction

These Terms of Service (“Terms”) set forth the rules and conditions for using the Obsera.com website (the “Website”) and the services provided through it (the “Services”). By accessing or using the Website or Services, you agree to these Terms and to our Privacy Policy.

By accepting these Terms, you confirm that:

• You are at least 18 years old.
• You have the legal authority to enter into these Terms on behalf of yourself or the organization you represent.
• If you do not agree to all of these provisions, you must not access or use the Website or Services.

I. Key Definitions

1. Operator – Neurotime LLC., Azerbaijan, Baku City, Ahmad Rajably str. 2/27
2. Website – the Internet portal available at https://obsera.com, operated by the Operator.
3. User – any natural person (18+), legal entity, or organizational unit that uses the Services.
4. Login – the User’s unique email address, used as an identifier.
5. Password – a confidential sequence of characters chosen by the User to secure access.
6. Account – an individual User profile on the Website, with personal or organizational settings.
7. Trial Period – a limited period defined by the Operator, during which an Account may be used free of charge.
8. Subscription Period – the paid duration of Account usage after the Trial Period ends.
9. Subscription Fee – the monthly fee specified in the applicable plan.
10. Subscription Plan – one of the pricing packages listed at https://obsera.com/prices.
11. Account Upgrade – moving to a higher-tier Subscription Plan at the User’s request.
12. Account Downgrade – moving to a lower-tier Subscription Plan at the User’s request.
13. Price List – the list of fees for Services available on the Website.
14. Registration – the process of creating an Account by completing the registration form.
15. Report – data summaries, analyses, or monitoring results generated through the Website.
16. Service(s) – internet and social media monitoring services and related features provided under these Terms.
17. Keyword – a word or phrase defined by the User for monitoring purposes.
18. Account Settings Panel – the area available at https://app.obsera.com/account, where Users manage Account details.
19. Agreement – the legally binding contract between the Operator and the User formed by accepting these Terms.

II. General Conditions

1. These Terms govern the use of the Website and Services, as well as the rights and obligations of the Operator and the User.
2. The Operator owns and operates the Website and is responsible for delivering the Services described herein.
3. Services include, among others:
   1. Monitoring of brand, product, or topic mentions online;
   2. Generating reports, summaries, and analytics;
   3. Sending notifications of new monitoring results;
   4. Archiving monitoring data.
4. Access to the Services is available only to registered Users or those authorized by a registered User. The User is responsible for actions performed by individuals to whom they grant access.
5. The Operator reserves the right to limit or restrict certain Services for Users who do not comply with these Terms.
6. The Operator may delegate daily Website operations to third parties, and by accepting these Terms, the User agrees to such arrangements.
7. The Website is available via the Internet. While the Operator takes reasonable measures to secure data transmission, Users acknowledge that no online transmission can be fully guaranteed.
8. The Operator is not responsible for technical issues arising from the User’s own equipment, software, or Internet connection that prevent proper use of the Website.

III. Account Registration

1. To use the Services, Users must register an Account by completing the registration form on the Website. This requires at least:
   1. A valid email address, and
   2. A chosen Password.
2. The Operator may request additional information during registration.
3. Once registered, the Account may be used free of charge during the Trial Period. After this period, continued use requires selecting and paying for a Subscription Plan.
4. For Subscription Periods:
   1. Individuals must provide full name and residential address.
   2. Legal entities/organizations must provide company name, tax identification number, and registered office address.
5. Upon selecting a Subscription Plan, the Operator will issue a pro forma invoice within 3 business days via the User Panel. A final VAT invoice will be made available after payment is received.
6. The Subscription Fee must be paid by the due date stated on the invoice. If payment is not received:
   1. After 7 days, the Operator may suspend access to the Account.
   2. After 14 days, monitoring of Keywords may be discontinued.
